“What should happen next is that the governor-elect should have the opportunity to fill vacancies on the board and for the re-constituted board to meet and determine what’s best to do for the university," she says. "We are looking forward to having a full board that can assess whether a new search should happen, what should occur with regard to a contract that the existing board has entered into.”
There are five vacancies on the board, and while those now serving were unanimous in casting a vote for Beardsley, Brown says some of them may have a change of heart.
“That’s the tradition when a president is chosen at UVA – that no matter what individual board members might have actually thought, they assess where the majority is and declare that their vote was unanimous. There may well be members remaining on that board who might agree that it was hasty and inappropriate.”
Pressure may come not only from Abigail Spanberger but from state lawmakers according to University of Richmond professor Carl Tobias.
“There is also some very strong and vocal members of the General Assembly who are, I think, quite upset," he says.
They want to know what really happened, behind the scenes, leading up to Ryan’s resignation.
“It certainly had the feeling of targeting," Tobias explains. "I think from the prospective of many people, Jim Ryan was the quintessential university president, and he did many things, not the least of which was to raise $6 billion.”
Ann Brown was quick to add praise for the man selected by the current board.
“Dean Beardsley is an accomplished leader at the Darden School. This is really in no way about Dean Beardsley.”
What it’s about, she says, is the process by which he was chosen after the faculty senate, the student council, state leaders and Wahoos4UVA all urged the board not to choose a new president until a new governor was sworn in.
“We who are all part of the stakeholder group at the university have watched the university struggle through a truly damaging and traumatic time. Any president chosen in a process led by this board is going to have a very tough time being successful as president of UVA.”
Nevertheless, Beardsley will take office January first – 16 days before Abigail Spanberger is sworn in.

The Charlottesville community will have to wait a bit longer for clarity on the city’s zoning code, as a lawsuit that threw development in the city into chaos earlier this summer continues.
During the latest hearing in Charlottesville Circuit Court on Aug. 13, Judge Claude Worrell did not issue an opinion and instead gave the parties in the lawsuit additional time to continue their arguments.
The recent confusion over the city’s zoning laws started after a June 30 hearing when Worrell ordered the City of Charlottesville to toss out its zoning ordinance and revert back to its old rules. His decision was a default judgment in favor of the plaintiffs, a small group of Charlottesville residents who sued the city alleging that the ordinance is invalid.
The new ordinance, which was compiled over several years with community input, was adopted by City Council in December 2023 and took effect in February 2024. Broadly, it allowed for more residential density throughout the city, something known as “upzoning.” Officials and some community members hoped that the new ordinance would open up more affordable housing opportunities for people of various economic statuses.
Worrell’s June 30 decision came not after a trial, but after the city’s outside counsel, Gentry Locke, missed a key filing deadline.
The decision left developers wondering what would happen to projects they’ve put time and money into as the city tried to figure out next steps. In mid-July, the city resumed operating under the 2024 development code while keeping zoning applications on hold. Some affordable housing projects are in limbo as all of this is worked out.
Previously, City Spokesperson Afton Schneider said that the city would try to reach a settlement with the plaintiffs. If it was unsuccessful, and if the court rules in plaintiffs’ favor, the city plans to file an appeal. Schneider said that the city is also prepared to take steps to re-adopt the ordinance if necessary. City Council took the first step toward that on Monday, July 21.
Worrell, the plaintiffs’s attorneys from Flora Petit, and the city’s attorneys from Gentry Locke were back in court Wednesday, Aug. 13 so that Worrell could hear the city’s motion to reconsider — and the plaintiffs’ motion opposing it.
The city’s motion argues that in his decision, Worrell did not properly consider that the city, who is the defendant in the case, was acting in “good faith.” (Charlottesville Community Engagement uploaded a copy of the motion; read it here.)
Normally a default judgment is issued when one of the litigants fails to show up, Gentry Locke attorney Michael Finney argued in the motion, and in the courtroom on Wednesday. But that’s not what happened here, Finney said. Instead, the city has been a very active participant, preparing for the trial in the case, which had been scheduled for 2026. Finney said that Gentry Locke takes responsibility for the mistake, which he called “humiliating,” and that the city — and its residents — should not be punished for it.
Attorneys for the plaintiffs asked the court to deny the city’s motion to reconsider for a few reasons, including that “motions to reconsider are disfavored and apply only in narrow circumstances,” that “the court properly applied the law and there is no basis for reconsideration,” and that “the city merely seeks to reargue a question that has already been decided.” (Charlottesville Community Engagement has a copy of the motion, filed on Aug. 6, here.)
After hearing arguments from Finney and Flora Petit attorney Ashley Hart on Wednesday, Worrell did not issue an opinion.
Worrell echoed something he’d said in June, when he issued the default judgment and lamented that the case wouldn’t ultimately go to trial.
“I thought it might be interesting to have a conversation about zoning, and what it means,” he told the 20 or so people who’d gathered in the courtroom for the hearing, including a few of the plaintiffs, Charlottesville Planning Commissioner Rory Stolzenberg, and a few journalists.
Instead, Worrell asked the plaintiffs to explain further to the court, in writing, about the suit’s key legal argument: that the City violated state law by sending just the transportation chapter of its comprehensive plan — and not the entire plan — to the Virginia Department of Transportation. Therefore, the suit alleges, the comprehensive plan adopted by the City Council in November 2021 is void. And if the comprehensive plan is void, so is the zoning ordinance it is based on, the suit argues.
Worrell gave the defense attorneys representing the city until Monday, Aug. 18 to reply. The plaintiffs would then have until Wednesday, Aug. 20 to file a response before Worrell releases an opinion on Friday, August 22.
The City of Charlottesville does not comment on ongoing litigation, city spokesperson Afton Schneider told Charlottesville Tomorrow in an email Wednesday afternoon.
Attorneys from Flora Petit did not immediately respond to a request for comment.

CHARLOTTESVILLE, VA – The City of Charlottesville and Charlottesville City Schools (CCS) announce the completion of a 262.9 kW solar photovoltaic (PV) system on the roof of Charlottesville Area Technical Education Center (CATEC). This system is the largest solar PV system in the City and CCS portfolio.
This summer, a new solar photovoltaic (PV) system which generates energy from the sun was installed on Charlottesville Area Technical Education Center (CATEC) and is now fully operational. This clean energy project started in May 2025 and was fully operational three months later in August 2025. It is expected this system will produce between 250,000 and 300,000 kWh per year and will meet over 60% of the building’s electricity need. So far, the system has produced over 76 MWh of electricity.
This climate action project represents a milestone in the City of Charlottesville’s commitment to clean energy adoption and resource conservation, aligning with the City’s community climate goals of reducing emissions 45% by 2030 and aiming for carbon neutrality by 2050. It leverages the City of Charlottesville’s contract with CMTA to design and deliver projects through a Master Energy Performance Contract aimed at improving energy efficiency, reducing water consumption, and decreasing greenhouse gas emissions. CMTA is an energy services company that delivers decarbonization and occupant health and wellness through energy efficient, sustainable projects.
CMTA teamed with a local solar system installation partner, Tiger Solar, as well as FLIPP Inc, a local nonprofit workforce development organization. Dedicated to fostering an inclusive workforce, FLIPP Inc offers renewable energy training, certification programs, and entrepreneurship development for individuals from disadvantaged backgrounds. This approach reflects the City’s commitment to local businesses and workforce development and intentional collaboration on climate action.
CATEC is a member of the Community Climate Collaborative’s Green Business Alliance (GBA), a network of Virginia-based businesses committed to reducing greenhouse gas emissions. The installation of this PV system is a major step towards achieving greenhouse gas reductions and utility bill savings at CATEC and demonstrates the organization’s leadership in the community.
“We’re thrilled to have this system deployed and now producing clean energy, showing students at CATEC firsthand how solar is a lucrative and viable industry to get into. The positive climate impacts, cost savings, and educational benefits made this an extremely important project for the City to pursue,” says Kristel Riddervold, Director of the City’s Office of Sustainability.
The City is planning for more PV installations across its portfolio of facilities.
